Most consumer grade (i.e. non-prescription) medicines and medical devices that can be sold online in Australia are regulated by law, and may be classified as ‘therapeutic goods’. This generally includes products like sunscreens, vitamin tablets, over the counter medicines like paracetamol and ibuprofen, as well heart rate monitors and other consumer grade medical devices.
These regulations generally do not extend to food type products like protein powers and foods, or cosmetics.
The Australian Register of Therapeutic Goods (ARTG) is the central database of therapeutic goods that can be legally supplied in or exported from Australia. Medical devices included in the ARTG have sponsors, who take legal responsibility for their supply in or from Australia. Sellers who sell any therapeutic goods on MyDeal are responsible for ensuring:
- Their goods are properly registered on the ARTG and comply with all other requirements of the Therapeutic Goods Act 1989 and any other relevant product safety laws; and
- Their listings comply with the Therapeutic Goods Advertising Code.
There are restrictions on the sale of certain medicines or products that can only be sold in a pharmacy or that require a prescription from a doctor.
MyDeal does not allow the sale of these types of products.
Sellers who breach these requirements may have their products removed or their seller accounts suspend or terminated.
